Since March 11, President Trump has imposed far-reaching travel restrictions on members of the Schengen countries by Proclamation 9993, as part of the measures to contain the pandemic. However, companies that are directly affected and have important customer orders to serve in the U.S. have the option of obtaining the appropriate visas for their personnel by means of an exemption. In addition to the usual visa application for a B1 business traveler visa, this requires a so-called National Interest Exception (NIE). The requirements essentially require that:

  •  a contractual agreement exists, which obliges the foreign company (DACH) to carry out or organize the work mentioned above,
  • the U.S. customer is threatened with serious financial losses if the employees are not allowed to come, and
  • the employee is demonstrably highly motivated to return to the respective home country after the work is completed.

The processing time at the consulates is usually less than 48 hours.

The NIE is also good news for E2 applicants. Since the processing of these visas has been largely suspended since the beginning of the pandemic, the U.S. Department of State has made it clear that investors, senior staff and specialists (so-called key personnel) may also enter on the E visa.

An update is also available for H and L visas. While these visas have not been issued since mid-April due to Proclamations 10014 and 10052, a federal court ruled earlier this month that the Proclamations were illegal. Unfortunately, the decision does not yet lead to the complete removal of this blockage, but the decision offers individual companies new ways to obtain the desired visa.
